TERMS AND CONDITIONS

Specific conditions for Web Development services

These conditions detail the exact scope of the services quoted through Gonzaru Dev. The acceptance of a quote and ticking the corresponding box on my forms implies understanding and legal conformity with these clauses.

1. Scope of Base Projects

  • Landing Page / One-Page: Custom design and development of a single page. Includes a contact form and basic technical SEO structure at the code level.
  • Corporate Website: Everything included in the Landing Page, expanded up to a maximum of 5 internal pages (sections navigable via menu).
  • E-Commerce (Shopify): Development of a complete online store. Once finished, legal and technical ownership is transferred to the client, who assumes payment of the monthly fee for the external platform (Shopify) to keep the store active.

Important: The base plans DO NOT include text writing, content creation (copywriting), branding design, or legal texts (GDPR). All this material must be provided by the client, unless its creation is requested as an extra service.

2. Client Responsibilities and Materials

External Costs: The client is solely responsible for the purchase and renewal of the Web Domain, as well as paying any subscription to third-party platforms necessary for its operation (e.g., Shopify, premium tools, professional email accounts).

Delivery of Materials: The client must deliver all texts, images, product descriptions, and legal documents through shared folders (Google Drive) at the start of the project. Each day of delay in delivering this material will automatically extend the final delivery deadline of the website by one day.

3. Extra Services Conditions

  • Extra Pages: Only applicable when the project requires exceeding the limit of 5 internal pages already included in the base plan (Corporate Website).
  • Database: Integration of secure cloud storage for structured records. The client is legally solely responsible (GDPR) for the third-party information they store.
  • Login and Registration: Creation of a secure authentication system (user/password) to restrict access to certain areas of the website.
  • E-commerce Notifications: Setup of automatic flows (e.g., abandoned cart recovery) using the platform's native tools. The client will assume the cost of such applications if they exceed the free sending limit.
  • Pro Technical SEO: Advanced technical configuration for search engines. Includes: dynamic metadata, Open Graph tags (visual cards for links on Social Media and messaging), friendly/semantic URLs, automatic generation of Sitemap.xml and Robots.txt, Structured Data (Schema JSON-LD for Rich Snippets), and AIO optimization (llms.txt file for Artificial Intelligences). It DOES NOT guarantee specific positions on Google nor does it include writing SEO-oriented content or articles.
  • Booking (Calendly): The client must register, create their account, and set up their availability schedules. I will exclusively handle the technical integration on the website.
  • Multilingual Website: Preparation of the web architecture with URL translations and SEO structure in multiple languages.
  • Static Blog / FAQs: Integrated design of a section for articles. The periodic upload of new content will require contracting the Monthly Maintenance plan.

4. Maintenance and Delivery

  • No Maintenance: The project is delivered finalized (ZIP file with source code or ownership transfer in Shopify). It entails a 25% surcharge on the base quote. Upon delivery, you assume full responsibility for the server, updates, future errors, or downtime.
  • Monthly Maintenance: Includes SSL security certificate, technical bug resolution, and a maximum of 3 minor modifications per month (text or image changes). For E-commerce projects, I will retain access as a 'Collaborator'. It does not include redesigning sections or creating new pages.
  • Non-Payment and Cancellation Conditions: In the event of non-payment of the maintenance fee, you will have 7 calendar days to regularize the situation. After this period, the service will be temporarily suspended. If the non-payment lasts for more than 30 days, the agreement will be automatically terminated. Voluntary cancellation: Either party may terminate the service by providing written notice 30 calendar days in advance.

5. Payments, Revisions, and Cancellations

Payment Conditions: Payment Terms: Project payments will be made in two phases: an initial 50% upfront payment to reserve the dates and begin development, and the remaining 50% upon project completion, which is a strict requirement for code delivery, production deployment, or ownership transfer.

Revision Limit: The design process includes a maximum of 2 rounds of free revisions. Any request for structural redesign or subsequent changes to functionalities will be quoted separately.

Tacit Acceptance: Once notified of the project's completion, you will have 10 calendar days to review and request the agreed modifications. If this period passes without communication, the project will be considered accepted and validated, proceeding to invoice the remaining 50%.

Project Suspension: If after the initial 50% payment, you stop communicating or fail to deliver the required materials for a period exceeding 30 calendar days, the project will be considered canceled without the right to an advance refund.

6. Exemption from Liability

I act as a technological integrator. The security of banking data, payment collection management, and server stability rely on third-party providers (payment gateways, hosting companies, etc.). I am exempt from liability in the event of external service outages, cyber attacks, or security breaches in third-party platforms.
